GOVERNOR VISITS CAHF FACILITY
Budget is topic as Schwarzenegger tours Community Care & Rehab Center in Riverside

The following message was e-mailed to CAHF members on Aug. 15.

Touring the state to rally support for passage of the state budget, Gov. Arnold Schwarzenegger on Aug. 15 visited CAHF member Community Care & Rehabilitation Center in Riverside.

"I've never seen so many happy patients," he quipped, then quickly turned serious, saying that essential state services such as long-term care depend on timely state funding.

"The ones who get hurt the most are vulnerable citizens," the governor said in a live Webcast from the 158-bed skilled-nursing facility. He suggested legislators "travel around with me to see conditions."

Bruce Bennett, president of Community Care & Rehab, thanked Schwarzenegger for his visit and told the governor, "Until a budget is signed, we're in a precarious position. . . . We need to get paid. . . . We can't just shut down."

Later, Bennett e-mailed fellow members on the CAHF forum to say the governor's visit "was a great experience for our residents and staff, and I truly hope that the media attention will help move this forward."

CAHF Public Affairs Director Betsy Hite, who attended the tour, said the media presence was impressive. "There was wall-to-wall press coverage, print and television - exactly what we need to publicize the plight of Medi-Cal beneficiaries and providers during this budget emergency."

CAHF SUES STATE OVER BUDGET
Hearing Aug. 21 in Sacramento

CAHF is going to court Aug. 21 to fight for Medi-Cal beneficiaries and providers whose funding has been cut off by the seven-week-old state budget impasse.

As reported to Association members in an e-mail alert, CAHF joined two providers, a client and a resident on Aug. 9 in filing a lawsuit seeking relief in U.S. District Court in Sacramento for the interruption in Medi-Cal reimbursement.

CAHF charged that the state's "failure to adopt a budget threatens to cause severe and irreparable injury to providers and Medi-Cal beneficiaries."

CAHF was joined in the lawsuit by Association members Duke Facilities of Stockton, which operates three intermediate-care facilities for people with developmental disabilities, and 48-bed Blythe Nursing Care Center, as well as by a Duke Facilities client and a Blythe Nursing Care Center resident.

The lawsuit declares: "The state has acknowledged that delays in Medi-Cal payment to long-term care facilities will force those facilities out of business since they typically lack sufficient reserves to continue operating without a steady stream of revenue and that any closures of these facilities would severely impact the vulnerable residents of these facilities, who may not be able to find other placement, in light of a statewide shortage of nursing-home beds."

Focusing on the issue of Medi-Cal contingency funds earmarked for use in the event of a budget delay – enacted in 1998 under CAHF-sponsored Assembly Bill 561 – CAHF stated that state officials knew "the failure to pay long-term care facilities for services provided to Medi-Cal beneficiaries would have grave consequences, and yet the Department erroneously asserted to the Legislature that it had sufficient funds to cover Medi-Cal payments to long-term care facilities."

However, as Medi-Cal providers throughout the state know, AB 561 contingency funds expired during July.

CAHF stated: "Despite assurances that the state would have sufficient funds to cover Medi-Cal payments to . . . long-term care facilities in case of a budged impasse, the state, beginning on Aug. 2, 2007, failed to pay long-term care facilities for services provided to Medi-Cal beneficiaries and will continue not paying . . . into the foreseeable future.

"This act will trigger the exact consequences of facility closure and patient-placement problems anticipated by the Legislature, in violation of federal law," CAHF stated.

The lawsuit also strongly protests the fact that the interruption in Medi-Cal payments is not evenhanded. CAHF charges: "Defendants have decided to pay non-institutional providers" – including such varied providers as audiologists, outpatient heroin detoxification centers and respiratory-care practitioners. "However, in violation of the federal Medicaid Act . . . , defendants have withheld payments from institutional providers," CAHF stated.

"As a result, [institutionalized beneficiaries] who rely on Medi-Cal to provide payment for long-term care services for them do not receive the same level of services as Medi-Cal beneficiaries who are not treated by institutional providers," CAHF stated.

The state's ongoing failure to make Medi-Cal payments "will imminently produce disastrous results," CAHF said.

CAHF INTRODUCES PANDEMIC FLU WORKBOOK
Publication makes debut at disaster-preparedness conference

On Sept. 10 we will be drawing the name of another member facility that has joined the campaign since July 16, so now is the time to sign up.

REGISTER SOON AND SAVE ON BRIDGE TO THE FUTURE
CEOs and administrators, directors of nursing services, social workers, activities directors, state and federal surveyors, ombudsmen and resident advocates – they're all invited to the California Culture Change Coalition's Bridge to the Future conference coming Sept. 18 to Sacramento and Sept. 19 to Glendale.

CAHF MEMBERS URGED TO RESPOND TO AB 1629 SURVEY
The following message was e-mailed to CAHF members on Aug. 14.

As you should be aware, an independent study on Assembly Bill 1629 is being conducted by researchers from Vanderbilt University and the University of California, Irvine.

The study will identify recent spending decisions by nursing-facility operators which will eventually appear on future cost reports.

Also, to the extent that operators did not change their spending behavior after implementation of AB 1629, the report will identify why and recommend future changes to motivate the desired spending behavior.

Finally, this initial survey will be followed up at some facilities by an in-depth, onsite review that will consider the opinions of nursing facility employees, residents and involved family members.

As such, we expect the final results from this effort to mirror the DHS report due January 2008, yet also reveal a more recent and in-depth picture of AB 1629's effect on nursing-facility measures that affect a resident's quality of care.

The current response rate to this study from Medi-Cal licensed facilities is at only 19 percent. In order for the results of this study to be truly representative of the entire SNF population in California, we need to achieve as high of a response rate as possible. Therefore, your prompt feedback is crucial to making accurate and informed decisions regarding AB 1629.

DEADLINES COMING FOR DME PROGRAM

Important deadlines are coming up for providers in the Riverside-San Bernardino-Ontario Metropolitan Statistical Area who want to take part in in the Medicare Durable Medical Equipment, Prosthetics, Orthotics and Supplies (DMEPOS) Competitive Bidding Program.

Since the Centers for Medicare & Medicaid Services extended some deadlines, facilities have until Aug. 27 to register and receive a user ID and password which will be necessary for the Internet-based bid-submission system.

All bids are now due by Sept. 25. Suppliers that have already submitted their bids may revise and resubmit their bids until the new deadline. Suppliers that resubmit bids must submit a new certification statement.

The U.S. Department of Homeland Security will sponsor the fourth annual National Preparedness Month in September.

For the first time, the month will focus on different areas of emergency preparedness, including older Americans, individuals with disabilities and special needs, along with home and family preparedness, during the week of Sept. 23-30.

Other focus weeks during National Preparedness Month are back to school, Sept. 1-8; business preparedness, Sept. 9-15, and multicultural preparedness, Sept. 16-22.
"It is vital that Americans take steps to prepare for emergencies at home, work or school," said Homeland Security Secretary Michael Chertoff.

CANDIDATES INVITED TO RUN FOR CAHF BOARD OF DIRECTORS
Each year at CAHF's Annual Convention, the House of Delegates elects statewide officers for the coming year. These officers are the chairman of the board, the vice chairman of the board and the secretary/treasurer.

The conferences and regional chairs who are also members of the CAHF Board of Directors are also elected at the Annual Convention for two-year terms. This year, Regions 1, 3 and 5 will elect chairs at the House of Delegates.

Also in 2007, the Independent Owners and Operators Conference, the Non- Proprietary Conference and the Developmental Services Conference will elect chairs at their respective conference meetings.

Anyone wishing to present herself or himself as a candidate for any statewide office, regional chair or conference chair should contact Sally Craven at the CAHF office to obtain an Application for Candidacy for Office form. This form should be completed and returned the CAHF office.

CAHF 2007 HOUSE OF DELEGATES CREDENTIALING RULES
On July 25, 2007, the Board of Directors adopted the following rules for the 2007 House of Delegates meeting to be held on Monday, Nov. 12, and Tuesday, Nov. 13, 2007 at the Wyndham Palm Springs Hotel in Palm Springs, CA.

1. Maximum House of Delegates not to exceed 200 delegates, plus the 14 voting members of the Board of Directors.

2. Allocation of 200 delegates to chapters will be based on the number of beds in the chapter as of Aug. 31, 2007, with each chapter having at least one delegate.

3. In determining the number of delegates for each chapter, only the number of beds recorded in CAHF's Executive Office by Aug. 31, 2007, will be used.

4. Members must have paid dues in full, as defined in the Bylaws, by the time of the first day's meeting of the House of Delegates to be eligible to serve as a delegate.

5. Each chapter will be notified of the number of delegates by Sept. 7, 2007 and must submit Certified Delegate Lists by Sept. 28, 2007. Any changes after that date must be approved by the Bylaws and Credentials Committee in conformity with the Bylaws of the Association.

6. Multi-facility companies, as defined in CAHF's Bylaws, will be asked to submit suggestions for delegates after the Chapter Delegate Lists are received in the CAHF office. Multi-facility companies must submit their suggested delegates by Friday, Oct. 12, 2007.
